These Terms of Service ("Terms") govern your access to reinierlopphotography.com and your use of photography services provided by Plash Link LLC, a Texas limited liability company doing business as Reinier Lop Photography ("we", "us", "the Photographer"). By using the site or booking a session, you ("Client") agree to these Terms.
1. Acceptance
You must be at least 18 years old to book a session or enter into a contract with us. Bookings on behalf of minors must be made by a parent or legal guardian.
2. Services
We provide portrait and lifestyle photography services in the Austin, Texas metropolitan area, including (but not limited to) personal branding, family portraits, quinceañeras, editorial portraits, and headshots. Specific package contents (number of edited images, session length, delivery format) are described on the site and confirmed at the time of booking.
3. Booking and payment
- Quote and confirmation. Sessions are scheduled once you accept the quoted price and pay the required amount.
- Payment processor. All payments are handled by Stripe. Major credit and debit cards are accepted. Sales tax is added where required by Texas law (currently 8.25% in Austin).
- Deposit. Where a deposit is required, it is non-refundable and is applied to the total session price. The deposit reserves your date and time and compensates us for turning down other bookings.
- Full payment. Unless otherwise agreed in writing, the balance is due before or on the day of the session.
- Tips. Tips are entirely optional and at your discretion. They do not affect service quality or delivery.
4. Rescheduling and cancellation by Client
- Rescheduling. You may reschedule once at no charge with at least 48 hours' notice. Additional reschedules, or reschedules with less notice, may incur a fee equal to 25% of the session price.
- Cancellation by Client. If you cancel more than 7 days before the session, you forfeit the deposit only. If you cancel within 7 days, the full session price is non-refundable unless we are able to fill your slot.
- No-show. If you do not arrive within 30 minutes of the scheduled start time and have not contacted us, the session is forfeited and no refund is owed.
5. Cancellation by Photographer; weather; force majeure
In the rare event we must cancel due to illness, equipment failure, or other emergency, we will offer (i) the next available rescheduled date or (ii) a full refund of all amounts paid, at your choice. For outdoor sessions affected by inclement weather, we will work with you to reschedule at no charge. Neither party is liable for failure to perform caused by events beyond reasonable control (natural disaster, government order, etc.).
6. Delivery
- Timeframe. Edited photographs are typically delivered within 2 to 4 weeks of the session via online gallery (Pixieset). Same-day previews may be provided as a courtesy but are not guaranteed.
- Number of edits. Each package specifies the number of fully edited images included. Additional edits are available at $10 per image.
- Unedited photos. Where the package states "all unedited photos delivered," those are provided as RAW-to-JPEG conversions without retouching. They are intended as a reference, not as a substitute for the included edits.
- Gallery availability. Online galleries remain accessible for at least 90 days from delivery. Please download and back up your files within that window.
7. Copyright, licensing and image use
This section is the heart of the Photography Service Agreement and applies to every paid session.
- Ownership. Under 17 U.S.C. § 201, the Photographer is the sole author and owner of all photographs and retains the copyright to all images, including delivered edits and unedited files, in perpetuity.
- Client license (personal use). Upon full payment, you receive a perpetual, worldwide, non-exclusive, royalty-free license to use, print, share and post the delivered images for personal, non-commercial purposes. This includes social media (with credit appreciated), prints for your home, gifts to family, and similar uses.
- Commercial use. Use of any image for paid advertising, promotion of a business, product, service, brand or for any commercial gain requires a separate, written commercial license from the Photographer, with pricing based on scope. Posting on a business social account counts as commercial use.
- Editing and integrity. You may not crop in a way that removes the watermark or signature (where present), nor apply additional filters, AI manipulations or color edits that materially alter the artistic intent of the image. Black-and-white conversion of color images is not permitted.
- Resale and redistribution. You may not sell, sublicense, transfer or distribute the images to third parties, news outlets, or stock libraries.
- Photographer's right to use images. The Photographer retains the right to use any image from your session for portfolio, social media, website, marketing, contests, publications and self-promotion, with credit. If you wish to opt out of this use, you must notify us in writing before delivery; an opt-out fee may apply for premium or branded sessions.
8. Model release
By participating in a session, you grant Plash Link LLC and its assignees the irrevocable right to use, reproduce and display photographs of you for the purposes described in Section 7. If your session involves minors, your booking confirms that you have legal authority to grant this release on their behalf. If you require a written, signed model release for your records, we will provide one.
9. Behavior and safety
We reserve the right to end any session immediately, without refund, if the Client, accompanying guests or location pose a threat to the Photographer's safety, are under the influence of drugs or alcohol to the extent it impairs the session, engage in harassment of any kind, or request content that is illegal or sexually explicit. Children must be supervised at all times.
10. Use of the website
You agree to use the website lawfully and not to: (i) attempt to gain unauthorized access to any portion of the site (including the admin area); (ii) interfere with the site's operation or security; (iii) scrape, copy or republish content (including portfolio images, which are protected by copyright) without written permission; (iv) impersonate any person.
11. Third-party links
The site may link to third-party services (Stripe, WhatsApp, Instagram, Pixieset, etc.). We are not responsible for the content or practices of those services. Your use of them is governed by their own terms.
12. Disclaimer of warranties
The site and our services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of viruses.
13. Limitation of liability
To the maximum extent permitted by Texas law, our total aggregate liability arising out of or related to your use of the site or our services — whether in contract, tort, statute or otherwise — shall not exceed the total amount you have paid to us for the session in question. In no event shall we be liable for indirect, incidental, consequential, special, exemplary or punitive damages, including lost profits, lost data, or emotional distress.
14. Indemnification
You agree to indemnify and hold harmless Plash Link LLC, its members, employees and contractors from any third-party claim arising out of your breach of these Terms, your unlawful use of the photographs, or your violation of any third party's rights.
15. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. The exclusive venue for any dispute is the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.
16. Dispute resolution
Before filing any legal claim, the parties agree to attempt to resolve the dispute in good faith via direct communication for at least 30 days. Many disputes can be resolved by a phone call. Small-claims court remains available to either party for matters within its jurisdiction.
17. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the website and the services.
18. Changes
We may revise these Terms from time to time. The updated version is identified by a new effective date. Continued use of the site or booking new sessions after that date constitutes acceptance of the revised Terms.

Estos Términos de Servicio ("Términos") regulan tu acceso a reinierlopphotography.com y el uso de los servicios fotográficos prestados por Plash Link LLC, una sociedad de responsabilidad limitada de Texas que opera como Reinier Lop Photography ("nosotros", "el Fotógrafo"). Al usar el sitio o reservar una sesión, tú ("Cliente") aceptas estos Términos.
1. Aceptación
Debes tener al menos 18 años para reservar una sesión o celebrar un contrato con nosotros. Las reservas en nombre de menores deben ser hechas por un padre o tutor legal.
2. Servicios
Prestamos servicios de fotografía de retrato y lifestyle en el área metropolitana de Austin, Texas, incluyendo (sin limitarse a) branding personal, retratos familiares, quinceañeras, retratos editoriales y headshots. Los contenidos específicos de cada paquete (número de imágenes editadas, duración, formato de entrega) se describen en el sitio y se confirman al momento de reservar.
3. Reserva y pago
- Cotización y confirmación. Las sesiones se programan cuando aceptas el precio cotizado y pagas el monto requerido.
- Procesador de pagos. Todos los pagos los procesa Stripe. Se aceptan las principales tarjetas de crédito y débito. Se añade impuesto a las ventas cuando lo exige la ley de Texas (actualmente 8.25% en Austin).
- Depósito. Cuando se requiera depósito, este es no reembolsable y se aplica al precio total. El depósito reserva tu fecha y hora y nos compensa por rechazar otras reservas.
- Pago completo. Salvo acuerdo escrito en contrario, el saldo debe pagarse antes o el día de la sesión.
- Propinas. Las propinas son totalmente opcionales y a tu discreción. No afectan la calidad ni la entrega del servicio.
4. Reprogramación y cancelación por el Cliente
- Reprogramación. Puedes reprogramar una vez sin cargo con al menos 48 horas de aviso. Reprogramaciones adicionales, o con menos aviso, pueden conllevar un cargo del 25% del precio de la sesión.
- Cancelación por el Cliente. Si cancelas más de 7 días antes de la sesión, solo pierdes el depósito. Si cancelas dentro de los 7 días, el precio completo de la sesión es no reembolsable, salvo que logremos cubrir tu espacio.
- No presentación. Si no llegas dentro de los 30 minutos posteriores al inicio programado y no nos has contactado, la sesión se pierde y no se debe reembolso.
5. Cancelación por el Fotógrafo; clima; fuerza mayor
En el caso poco probable de que debamos cancelar por enfermedad, falla de equipo u otra emergencia, ofreceremos (i) la próxima fecha disponible para reprogramar o (ii) reembolso completo de todos los montos pagados, a tu elección. Para sesiones al aire libre afectadas por mal clima, trabajaremos contigo para reprogramar sin cargo. Ninguna parte es responsable por incumplimientos causados por eventos fuera de su control razonable (desastre natural, orden gubernamental, etc.).
6. Entrega
- Plazo. Las fotografías editadas se entregan habitualmente en 2 a 4 semanas tras la sesión, mediante galería online (Pixieset). Podemos compartir previews el mismo día como cortesía, pero no están garantizados.
- Número de ediciones. Cada paquete especifica el número de imágenes editadas incluidas. Ediciones adicionales tienen un costo de $10 por imagen.
- Fotos sin editar. Cuando el paquete indica "todas las fotos sin editar incluidas", se entregan como conversión RAW a JPEG sin retoque. Sirven como referencia, no como sustituto de las ediciones incluidas.
- Disponibilidad de la galería. Las galerías online permanecen accesibles al menos 90 días desde la entrega. Por favor descarga y respalda tus archivos dentro de ese plazo.
7. Derechos de autor, licencia y uso de imágenes
Esta sección es el corazón del Acuerdo de Servicio Fotográfico y aplica a toda sesión pagada.
- Propiedad. Conforme a 17 U.S.C. § 201, el Fotógrafo es el único autor y propietario de todas las fotografías y conserva los derechos de autor de todas las imágenes —incluyendo entregas editadas y sin editar— a perpetuidad.
- Licencia al Cliente (uso personal). Al pago completo, recibes una licencia perpetua, mundial, no exclusiva y libre de regalías para usar, imprimir, compartir y publicar las imágenes entregadas con fines personales y no comerciales. Esto incluye redes sociales (se agradece crédito), impresiones para tu hogar, regalos a familiares y usos similares.
- Uso comercial. El uso de cualquier imagen para publicidad pagada, promoción de un negocio, producto, servicio, marca, o cualquier ganancia comercial requiere una licencia comercial escrita aparte del Fotógrafo, con precio según el alcance. Publicar en una cuenta de redes sociales de negocio cuenta como uso comercial.
- Edición e integridad. No puedes recortar de forma que elimines la firma o marca de agua (cuando exista), ni aplicar filtros adicionales, manipulaciones con IA o ajustes de color que alteren materialmente la intención artística de la imagen. No se permite la conversión a blanco y negro de imágenes en color.
- Reventa y redistribución. No puedes vender, sublicenciar, transferir ni distribuir las imágenes a terceros, medios de comunicación o bancos de imágenes.
- Derecho del Fotógrafo a usar las imágenes. El Fotógrafo conserva el derecho de usar cualquier imagen de tu sesión para portfolio, redes sociales, sitio web, marketing, concursos, publicaciones y autopromoción, con crédito. Si deseas optar por no participar, debes notificarlo por escrito antes de la entrega; puede aplicar un cargo de opt-out para sesiones premium o de marca.
8. Autorización de imagen (model release)
Al participar en una sesión, otorgas a Plash Link LLC y sus cesionarios el derecho irrevocable de usar, reproducir y exhibir fotografías tuyas para los fines descritos en la Sección 7. Si tu sesión involucra a menores, tu reserva confirma que tienes autoridad legal para otorgar esta autorización en su nombre. Si necesitas un model release escrito y firmado para tus registros, te lo proporcionaremos.
9. Comportamiento y seguridad
Nos reservamos el derecho de terminar cualquier sesión de inmediato, sin reembolso, si el Cliente, los acompañantes o el lugar representan una amenaza para la seguridad del Fotógrafo, están bajo la influencia de drogas o alcohol en grado que afecte la sesión, incurren en acoso de cualquier tipo, o solicitan contenido ilegal o sexualmente explícito. Los niños deben ser supervisados en todo momento.
10. Uso del sitio web
Aceptas usar el sitio de forma lícita y no: (i) intentar acceder sin autorización a ninguna parte del sitio (incluida el área administrativa); (ii) interferir con la operación o seguridad del sitio; (iii) extraer, copiar o republicar contenido (incluyendo imágenes del portfolio, que están protegidas por derechos de autor) sin permiso escrito; (iv) suplantar la identidad de cualquier persona.
11. Enlaces a terceros
El sitio puede enlazar a servicios de terceros (Stripe, WhatsApp, Instagram, Pixieset, etc.). No somos responsables del contenido ni prácticas de esos servicios. Tu uso de ellos se rige por sus propios términos.
12. Renuncia de garantías
El sitio y nuestros servicios se prestan "tal como están" y "según disponibilidad". En la máxima medida permitida por la ley, renunciamos a toda garantía, expresa o implícita, incluyendo comerciabilidad, idoneidad para un fin particular, y no infracción. No garantizamos que el sitio esté libre de interrupciones, errores ni virus.
13. Limitación de responsabilidad
En la máxima medida permitida por la ley de Texas, nuestra responsabilidad total agregada derivada o relacionada con el uso del sitio o de nuestros servicios —ya sea en contrato, agravio, ley u otro— no excederá el monto total que nos hayas pagado por la sesión en cuestión. En ningún caso seremos responsables por daños indirectos, incidentales, consecuentes, especiales, ejemplares o punitivos, incluyendo lucro cesante, pérdida de datos o angustia emocional.
14. Indemnización
Aceptas indemnizar y mantener indemne a Plash Link LLC, sus miembros, empleados y contratistas de cualquier reclamación de terceros derivada de tu incumplimiento de estos Términos, tu uso ilegal de las fotografías, o tu violación de derechos de terceros.
15. Ley aplicable y jurisdicción
Estos Términos se rigen por las leyes del Estado de Texas, sin tener en cuenta principios de conflicto de leyes. La jurisdicción exclusiva para cualquier disputa son los tribunales estatales o federales ubicados en el Condado de Travis, Texas, y consientes la jurisdicción personal allí.
16. Resolución de disputas
Antes de presentar cualquier reclamación legal, las partes acuerdan intentar resolver la disputa de buena fe mediante comunicación directa por al menos 30 días. Muchas disputas pueden resolverse con una llamada. El tribunal de menor cuantía (small-claims) sigue disponible para cualquiera de las partes en asuntos dentro de su jurisdicción.
17. Divisibilidad y acuerdo completo
Si alguna disposición de estos Términos resulta inejecutable, las disposiciones restantes seguirán en pleno vigor. Estos Términos, junto con la Política de Privacidad y la Política de Reembolso, son el acuerdo completo entre tú y nosotros respecto al sitio y los servicios.
18. Cambios
Podemos revisar estos Términos periódicamente. La versión actualizada se identifica con una nueva fecha de vigencia. El uso continuado del sitio o nuevas reservas después de esa fecha constituyen aceptación de los Términos revisados.
